Registered practitioners in siddha, ayurveda, homeopathy and unani are eligible to practice surgery, obstetrics and gynaecology, anaesthesiology, ENT, ophthalmology, etc -Madras High Court Verdict

CHENNAI:The Madras high court has said registered practitioners in siddha, ayurveda, homeopathy and unani are eligible to practise surgery, obstetrics and gynaecology, anaesthesiology, ENT, ophthalmology, etc.
 
Justice F M Ibrahim Kalifulla, passing orders on a contempt of court petition filed by the Tamil Nadu Siddha Medical Graduates Association, also said penal action against such practitioners who dabbled in allopathy should be "dropped forthwith."
 
The ruling runs contrary to a recent order delivered by another judge on a petition filed by two unani practitioners who sought similar relief. In February this year, Justice K K Sasidharan had held that practitioners of Indian system of medicines should not practise allopathy, and that there was nothing wrong if police take action against those who attempt to practice allopathy without valid qualification.

While passing orders on Thursday, Justice Kalifulla took note of a June 29 circular of the government, which, citing section 17(3)B of the Indian Medicine Central Council Act 1970, said institutionally qualified practitioners of siddha, ayurveda, unani and homeopathy are eligible to practise the respective system with modern scientific medicine "including surgery and obstetrics and gynaecology, anaesthesiology, ENT, etc. based on the training and teaching."
 
The government's latest stand on the issue smacks of ambiguity while dealing with alternative systems of medicine which it seeks to promote even while claiming to check illegal practitioners.
 
The recent crackdown had seen several traditional practioners being booked for prescribing allopathic drugs.
 
Recording the details, Justice Kalifulla said: “It is imperative that no proceedings can be initiated against any of those registered practitioners in siddha, ayurveda, homeopathy and unani, who are eligible to practise the respective system along with modern scientific medicine including surgery, gynaecology and obstetrics, anaesthesiology, ENT, ophthalmology, etc.

If any action had been taken against such medical practitioners, it is needless to state that such action should be dropped forthwith...”
Reacting to the latest order, state health secretary VK Subburaj said they were just making use of the provisions in the Act. “But this is allowed only for those who attended colleges and underwent training for surgeries.

  3. It is benificial to homoeopathy and homoeopaths too, because our homoeopathic medincines work in all cases, and surgery basically requires management and after management homoeopathic medicines can be given for the treatment, sometimes palliatively also.
    After all it requires a lot of practice and need of reform in medical education.
    I am sure in future homoeopaths will be able to do surgery with their own medicine and management.

  4. no.its not beneficial.there is a high chance of eradication of the whole homoeopathy system,by practising the poly pharmacies,needless huge prescriptions makes no worthe for the homoeopathy.iam sorry.but still its true.

  5. it will be highly beneficial for all humanity as well as docs too. Ayush practitioners also studied the same as modern system , the lacking point is they never encoraged for surgery, gynae, obstet, ENT etc, to practice.
    NOTE: IF WE HOMEOPATHS ARE NOT ELIGIBLE TO PRACTICE THE SAME THEN WHY NOT CENTRAL COUNCIL OF HOMEOPATHY AMEND THE WHOLE SYLLABI AND ELIGIBILITY FOR HOMEOPATHY...........

  6. You are right Dr.Amit...lack proper training is the main problem..Teaching methodology and facilities are to be improved a lot..Let us hope at least current CCH may do good...Past CCH team was really business minded people than homeopaths

  7. I think this is the good decision .But I would like to recommend the 6 months enhanced training of the pharmacology is mandatory for the all homoeopaths and ayurveda doctors.

    Its a encouraging sign - our institutional qualitfications, DHMS, BHMS THE LETTER S IN THE LAST IS 'SURGERY', there are Homoeopaths who are conduction caesarrean operations , running nursing homoes few are doing really good work with their personnel acquired knowledge.
    But second side of the coin few have started advocating this ruling " we can prescribe allopathic drugs '
    The Ayush department should take a serious note of this, and take care of this being misused.

I DIDN'T DIGEST THE VERDICT BECAUSE AS A B.H.M.S STUDENT,WE ARE STUDYING SURGERY,OBG,ENT ETC WITH HOMOEOPATHIC THERAPEUTICS ONLY NOT WITH ALLOPATHIC DRUGS...WE ARE STUDYING HOMOEOPATHIC PHARMACOLOGY ONLY NOT THE ALLOPATHY.....SO HOW COULD BE WE ARE ALL MASTERS IN ALLOPATHY PRACTICE....EVEN ALLOPATHY MEDICINES GIVEN BY A TRAINED,EXPERIENCED ALLOPATH IS ALSO PRODUCING UNNECCESSARY REACTION IN PATIENTS.THEN HOW COULD WE VERY KEEN IN SELECTING THE ALLOPATHIC DRUGS...

  14. i think it is beneficial for whole systems of ayush b/as it will give a new thought to the people,the new thinking will generate in peoples mind that we ayush doctors are as eligible as allopaths.the scope for the doctors will rise and demand of ayush doctors in daily practise will increase.=

  16. I think by keeping all class people in mind govt has to change the guide lines,it is good to permit all AYUSH doctors to practice allopathy medicines. They have to treat systematically with well knowledge and experience, should not use un-necessary steroids. Due to non availability of the MBBS doctors in all the parts of the country have to accept,
    Eg- a daily labour can not afford the consultation fee in private Nursing homes and costly doctors. they will charge Min Rs-100/- and with Rs-200/- Medicines. is it possible to bare by a cooli who will earn Rs 50-100/day.

    the AYUSH doctors also has to up-date their knowledge day to day and they have to think twice and prescribe the drugs. finally safety of a patient is important a to a Doctor,it means before treating the patient one should choose the treatment like which system of medicine is good and safe to the ongoing disease condition.
    Treat the patients like our own family members, only in Emergency condition use the Allopathy drugs not for all the conditions like Longstanding diseases(Arthritis,Liver disorders, PID diseases, Migraine etc)
    We have a very good medicines to treat all the conditions.

    Kindly fallow the medical Ethics in the daily practice, need to practice with good quality.
    Should not be a miney minded.
    Should not prescribe all generic medicines.
    A good quality doctor will serve the socity.

    Dear All,

    In one country why the Rules and regulations are different.
    Eg why this difference one state will accept AYUSH doctors practice all systems of medicines and few states are not.
    I feel the Central Govt should take some decissions to uniform the condition across in INDIA.
    kindly up date the feature plans in other states like Andra pradesh,karnataka etc,

    I feel like TN state other states also has to permit to practice any system..........

  18. yes, its a good move by TN COURT, IT is going to support homeopathy and homeopath. because you know most people dont come to homeopathy because they think during an emergency crisis they have to consult a allopath, so to gain the basic confidence of patient we must be prepared to manage any condition.

CCH, CCRH WHAT THESE AUTHORITIES ARE DOING????? i am happy to hear this desicion , atleast high court bother about ayush docs BUT OUR REGULATORY BODIES NEVER THOUGHT ABOUT IT, SIMPLE REASON IS ONE WHO SELECTED FOR GOVT. JOB THEY FORGOT THEIR COLLEGUES, our regulatory body must equilize the all systems ALL OVER INDIA SOON so that ayush docs never feel inferiority complex when they came in practice.

  22. There are two things should consider about this judgement. We homeopaths have no idea about things what we can do. Now it is clear that what we can do. States like W.B. and kerala homeopathy is femilar to the public. But states like Tamilndu, the opertunity for doctors are very less. I really hope that the popularisation will be increased in such states. The real homeopaths can practice their own way,and patients may search such people in long run.

    As per this order homeopaths can also practice surgery, and take delivery...ENT and other thing we already doing..Never prescribe allopathy medicine...currently not in Delhi...

  27. As per oder we can have anesthesia?? But that is dangerous..it is only an order..Govt. has to decide whether it is to be implemented or not.
    If TN Govt. implementing it...it may be adopted by other states also...since Heath come under the purview of State Govts

  28. I think it is benificial for all of us as performing minor procedure like suturing needs local anastesia wich we dont have in our homeopathy.
    and I know there will no death of homeopathy if allopathic medicine is allowed because we know that we have good drugs in homeopathy for all conditions and we will practice it.why are we so insecure if our system is so powerful????

  29. good. our system is same as other systems as every system has pros n cones, but if this decision will be sanctioned all over india it will surely increase our confidence not the misuse of allopathy. as now we in emergency we feel helpless which makes ourself feeling "that are we docs?" hope govt. n ayush deptt. will soon take positive action with open eyes.

    The homoeopathic graduates in surgury must undrego training of operative surgury.

  35. As far as surgery & other Allied practice is considered, i look forward the way, the extent of expertize a physician has, if its all well there should be no tech hindrance.
    Also in these days of consumerism it is advisable to associate in superspecialist team and then to move ahead which will not only help physician to grow always but also quality delivery of services when mush has not been received at graduate level.
    Also i agree to this idea of PG in subjects such as anatomy, physiology, biohemistry, pathology , community medicine, fmt. But with the idea that atleast it can be done through the DNB to begin and to open its entrance exam to BHMS / Ayush Graduate. let us allow to compete with other students at par.

  37. dear D,Pradeep giving local anasthesia is not dangerous if u take training properly during our college period. in emergency we as a doctor should be able to help fellow humanbeing or should we let patient bleed to death or suture him without anasthesia in crude manner?

  38. Sir, you rightly said, 'if properly trained.' That is what I am also thinking . One should practice only what one is trained in. What training can give you possibilities of adverse reactions due to even local anesthesia. To consider local anaesthesia very simple only tells that one has never been exposed to the complications. There is no question about a person saving life in good intention. That does not amount to the right to practice. There is no problem if there is local anaesthesia in AYUSH way. But to practice and use a totally different system than one is qualified in is dangerous and can prove more fatal than the disease itself.

    Is its reference useful to institutionally qualified practitioners of homeopathy ?

    .....eligible to practise the respective system with modern scientific medicine "including surgery and obstetrics and gynaecology, anaesthesiology, ENT, etc. based on the training and teaching."
    Does it sets priority to practise alloapthy or recognises the eligibility based on certain condition?

    Lastly one has to remember the consequences of use of knife depends the way the user use it.

    it helps to cut fruits, vegetables, ofcourse sometimes to open screws and at times to kill the life the gift of god.

It is beneficial in homoeopathy.But it should be considered some what seriously.While i read the comments of other doctors i found that UNITY is lack among our homoeopaths.As a doctor's comment anaesthesia is lacking in our system.For using anaesthesia we should have training from a good anaesthestologist.Whether it is practical or not i dont know.
    Another think that i would like to share is that today homoeopathy is different from Hahnemanian period. we all know. in such a situiation an order like this is beneficial. We are homoeopaths so always select medicine according to our FIXED principles.With this view practising surgery, obs&gync is not a wrong thing.

  45. Either provide these docs some kind of training before they can practise allopathy, or- better still- separate these fields, and let them go back to practising what they are actually qualified in!... There are human lives at stake, for heaven's sake!...
